Terms of service

Effective Date: January 1, 2025

These Terms of Sale & Collector Agreement apply to purchases and acquisitions made through Art R us, including website purchases, gallery purchases, art-fair purchases, invoice purchases, telephone or email transactions, wire transfers, card payments, private sales, commissions, reserves, and special orders. Any written invoice, order confirmation, commission agreement, certificate, or other transaction-specific document supplements these Terms. If a transaction-specific document expressly conflicts with these Terms, that document controls for that transaction.

FINAL SALE
Due to the exclusive, original, limited, and frequently one-of-one nature of the artworks presented by Art R us, all sales are final and non-refundable except where required by applicable law or expressly agreed in writing. Art R us does not accept returns, exchanges, or cancellations based on a change of mind for original artworks, commissioned pieces, limited editions, sculptures, installations, custom works, special orders, or reserved artworks.

AVAILABILITY
All artworks are subject to prior sale and availability. An artwork is not considered sold until the transaction has been accepted by Art R us and the required cleared payment has been received, unless otherwise confirmed in writing. Art R us may withdraw an artwork before final acceptance of a transaction.

PRICING AND PAYMENT
Prices may change without notice unless confirmed in writing. Unless expressly stated otherwise, pricing does not include shipping, crating, insurance, taxes, duties, customs charges, storage, delivery, installation, or third-party services. Applicable taxes and governmental charges are the collector's responsibility unless expressly stated otherwise in writing.

TITLE AND RIGHTS
Upon receipt of the required cleared payment, title to the physical artwork transfers as provided in the applicable invoice or transaction document. Transfer of the physical artwork does not transfer copyright, reproduction, licensing, merchandising, trademark, publicity, or other intellectual-property rights unless expressly granted in writing by the applicable rights holder.

SHIPPING AND DAMAGE
Shipping and delivery timelines are estimates unless expressly confirmed in writing. Art R us coordinates in good faith with the collector and authorized carrier. If Art R us cannot ship within an expressly promised timeframe, it will provide the notice and options required by applicable law. Damage should be reported promptly and, when reasonably possible, within 48 hours of confirmed delivery with photographs of the artwork, packaging, shipping label, and visible damage. Retain all packaging while a claim is reviewed.

WEBSITE ACCURACY
Art R us makes reasonable efforts to present descriptions, images, dimensions, materials, prices, and availability accurately. Colors, textures, finishes, framing details, and perceived scale may vary because of photography, lighting, screen settings, and display conditions. Confirmed written transaction documents control over general website content.

LIABILITY AND LAW
To the fullest extent permitted by applicable law, Art R us will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages arising from a transaction, shipment, delivery, installation, website use, or third-party service. Nothing excludes rights or remedies that cannot legally be excluded. These Terms are governed by Florida law, and disputes will be handled in the appropriate state or federal courts in Collier County, Florida unless applicable law requires otherwise.
